On Aug. 19, 2025, Governor Jim Pillen announced that the State of Nebraska entered into an agreement with the Department of Homeland Security to convert the existing minimum-security Work Ethic Camp in McCook into a migrant detention facility and deportation hub.

Since the announcement, many important questions have been raised about this plan, including:

  • Impact on current inmates: Where will the individuals currently housed at the Work Ethic Camp be relocated and will they continue to receive the rehabilitative services currently offered?

  • Legal authority: Did the Governor have the authority to enter into this agreement? The Nebraska Constitution grants the Legislature—not the governor—the power over the “general management, control, and government of all state charitable, mental, reformatory and penal institutions.”

  • Oversight and accountability: If the ICE facility remains under the Department of Correctional Services, would it be subject to the same legislative oversight mechanisms, such as the Ombudsman’s Office or the Office of Inspector General for Corrections?

  • Financial implications: What will the conversion to an ICE facility—and the deployment of Nebraska National Guard members and state troopers to assist ICE—cost Nebraska taxpayers?

  • State identity and values: Nebraska is known as “The Good Life” state. Is this the image we want to project if we become home to what some are already calling the “Cornhusker Clink”?
